Huang v Body Corporate for the Dorchester CTS 10749 [2026] QCA 147: Court of Appeal Delivers Judgment on Human Rights in Civil Proceedings
Last year, Jason Dudley appeared for the respondent body corporate in an appeal raising novel questions in the context of a body corporate adjudication and the Human Rights Act 2019 (Qld). In particular, the question arose as to whether the Human Rights Act requires courts and tribunals to directly apply human rights in civil proceedings (here, the right to property under s 24). The Attorney-General (represented by G Del Villar KC S-G with K Blore) and the Human Rights Commission (represented by P Morreau KC) intervened. On 7 August 2026, the Court of Appeal (Bond, Brown and Bradley JJA) handed down its judgment in favour of the respondent. The judgment can be found here.
